What are the steps in a criminal court case?

California criminal court steps for misdemeanor charges are as follows:

  1. Arraignment: This is the first court appearance and when the judge tells the defendant what the charges are and the defendant decides how to plead.

  2. Pretrial: If the defendant pleads not guilty, the pretrial period is used to exchange discovery information, file pretrial motions, modify pleas and discuss ways to resolve the case without going to trial.

  3. Trial: Under California law, everyone accused of a crime is presumed innocent until proven guilty in trial or they plead guilty. Prosecution must establish guilt “beyond a reasonable doubt” which is the highest legal burden.

How can I win a criminal case?

Under U.S. law, government prosecutors must prove guilt beyond a reasonable doubt in criminal cases. This high standard is notoriously difficult to meet. How long do I have to make an injury claim?

Personal injury victims are required to file a claim or lawsuit within a limited amount of time from the date of injury, the “statute of limitation.” California laws define different statute of limitations depending on the type of personal injury as follows:

  • Injury to Person: 2 years

  • Damage to Personal Property: 3 years

  • Fraud: 3 years

  • Government agency, agent or employee: 6 months (Gov §911.2)

  • Medical Malpractice: 1 year from discovery, 3 years if injury is known

What is the “Patient’s Right to Know Act?”

The Patient’s Right to Know Act SB1448 requires that doctors notify their patients and obtain signed disclosures if they are placed on probation for sexual misconduct, drug or alcohol abuse, inappropriate prescriptions, or convictions that involve harm to a patient.

This law became effective July 1, 2019 and applies to all healing arts licensees, including those licensed by:

  • Medical Board of California

  • California Board of Podiatric Medicine

  • Osteopathic Medical Board of California

  • Naturopathic Medicine Committee

  • State Board of Chiropractic Examiners

  • Acupuncture Board

What laws govern the practice and responsibilities of nurses?

California’s Nursing Practice Act (NPA) defines the scope of practice and responsibilities for Registered Nurses. These laws govern how the Board of Registered Nursing achieves it’s consumer protection mandate and form the basis of nurse disciplinary actions.

Criminal and Immigration

What are deportable offenses for non-US citizens?

  1. Aggravated felonies as defined in INA § 101(a)(43).

  2. Violent crimes, theft or forgery with imprisonment of at least 1 year.

  3. Crimes of moral turpitude.

  4. Fraud, tax evasion, or money laundering with losses exceeding $10,000.

  5. Rape, murder, kidnapping, child pornography or sexual abuse of a minor.

  6. Trafficking in guns, illicit drugs, humans or destructive devices.

While these are the most common offenses, the Immigration and Nationality Act (INA) Act 237 and INA § 101(a)(43) define a long list of “crimes of moral turpitude” and “aggravated felony" crimes that are the basis for U.S. deportation laws.
