Board of Chiropractic Examiners disciplinary guidelines
The Board of Chiropractic Examiners (BCE) reported they had approximately 13,191 licensed California chiropractors in 2017.
BCE is a consumer protection agency under the California Department of Consumer Affairs with the primary mission of protecting consumers of chiropractic services from potentially harmful licensees. BCE published statistics show they received 497 consumer complaints and referred 495 complaints for investigation in fiscal year 2017.
BCE has a complex system of categorizing offenses and deciding the appropriate disciplinary action. To achieve its consumer protection mandate, BCE has codified its rules in the Board of Chiropractic Examiners Disciplinary Guidelines & Model Disciplinary Orders.
The California Department of Consumer Affairs reports quarterly on the quantity of chiropractor consumer complaints received, enforcement actions and convictions.
Chiropractor Criminal Reporting Requirement
California Business and Professions Code §803.5 requires the District Attorney or other prosecuting agency to file a report informing the State Board of Chiropractic Examiners of the filing of any felony criminal charge.
Once a licensee is convicted of a crime, courts are required to transmit a certified copy of the record of conviction to the BCE within 48 hours. When a licensee renews their Chiropractic license, they must report any criminal convictions. While there is no law requiring it, law enforcement agencies often report criminal arrests to the BCE. Depending on the facts, disclosures typically trigger an investigation of the licensee.
Chiropractic license criminal record changes (AB-2138)
Assembly Bill 2138 limits the discretion and chiropractic licensure denial criteria making it easier for prospective licensees with criminal records to obtain and maintain chiropractic licenses effective July 1, 2020.
